Standard Trading Terms & Conditions of Logistics Connection Limited.

Standard Trading Terms & Conditions

All business is transacted subject to the following terms and conditions.

1. Freight Forwarding

1.1 Currency & Payment

Some charges may be quoted in foreign currencies. Where this applies, payment must be made in New Zealand Dollars, and a collection surcharge will apply to all foreign currency conversions.

Disbursements paid on a client's behalf may include a margin to cover our accounting and administration costs.

1.2 Insurance

Insurance is not included unless specifically requested in writing and agreed between the parties. We can arrange competitively priced insurance cover for both air and ocean consignments on request.

1.3 Rates & Surcharges

All quotations are based on rates supplied to us by the relevant carrier and are subject to change without notice.

Fuel and security surcharges are correct at the time of quotation but may change at any time, with or without notice.

External variable charges, such as airline fuel surcharges, may not always be quoted upfront but will be charged at cost when they apply.

We reserve the right to change specified carriers, flights, or sailings.

1.4 Consolidation Services

All freight services are provided on a consolidation basis unless otherwise specified in writing.

1.5 Weight & Volume Calculations

Airfreight: volumetric weight is calculated at 167 kilograms per cubic metre. Chargeable weight is whichever is greater — actual or volumetric.

Seafreight: international consignments are rated on weight or volume at a conversion rate of 1 cubic metre to 1,000 kilograms, with the higher figure applying unless otherwise agreed in writing. A minimum charge of 1 cubic metre or 1,000 kilograms (whichever is greater) applies unless otherwise specified in writing.

1.6 Information Accuracy & ETAs

Every effort is made to ensure information shown in our Glasshouse Information System is accurate; however, Logistics Connection cannot be held liable for decisions made, or consequences arising, from reliance on this information.

Estimated Time of Arrival (ETA) figures may change without notice and are estimates only, based on information available to Logistics Connection and its agents.

1.7 Restricted Cargo

Oversized, perishable, valuable, and hazardous cargo are excluded from these rates unless otherwise specified in writing.

1.8 Storage of Goods

Goods held in our bonded warehouse awaiting collection will incur storage charges: $0.20 per kilogram per day for airfreight, and $10 per m³ per day for LCL. A minimum charge of $25 applies to all storage.

2. Logistics & Warehousing

2.1 Pallet Definition

One pallet is defined as not exceeding 1 cubic metre or 1 tonne.

2.2 Storage Week

The storage week runs from Sunday to Saturday. All product arriving during a given week is subject to storage for that full week.

2.3 Risk & Insurance

All goods are stored at the owner's risk. Clients should arrange their own insurance cover.

2.4 Pallets & Packaging

Where Chep pallets are required, these will be processed to the client's account.

Stretch wrap is available on request and will be charged at cost.

2.5 Stock Records

Our quoted charges include maintenance of computerised stock records. These are kept up to date and available to your company at all times via our web-based Glasshouse platform, which shows product movement information and current balances.

Every effort is made to ensure information shown in our Glasshouse Information System is accurate; however, Logistics Connection cannot be held liable for decisions made, or consequences arising, from reliance on this information.

3. Payment Terms

For export consignments sent on a collect basis, the shipper remains liable for any and all charges incurred at origin, in transit, or at destination that the consignee does not pay within our payment terms.

  • Disbursement charges are payable immediately.
  • Export airfreight charges are due within 14 days of the shipment date.
  • Non-disbursement invoices are payable by the 20th of the month following the invoice date.

4. Overdue Accounts

If full payment is not made by the due date, then without prejudice to any other remedies available to us, Logistics Connection may:

  • Cancel or withhold the supply of goods or services;
  • Charge interest on overdue amounts at a rate 7.5 percentage points above the company's bank overdraft rate, calculated daily from the due date until payment is made;
  • Recover from the customer all costs incurred in collecting overdue monies; and
  • Exercise a particular and general lien over the customer's goods, cargo, and related documents — whether or not currently in our possession — for all sums owed (overdue or not), including the right to sell such goods by public auction or private treaty without further notice to the customer.

5. Demurrage & Detention

While Logistics Connection will do all it reasonably can to avoid additional charges, demurrage at port or detention on containers will be for the account of the Shipper (exports) or Consignee (imports), except where clearly shown and agreed to have resulted directly from our negligence.

Clients are expected to give at least 48 hours' notice (excluding weekends) once containers have been devanned and are ready for return. Advance bookings are required to arrange the return of empty containers, so good notice is essential.

If we are asked to bring containers to our yard for any reason before final delivery, an extra leg charge and on-yard storage charges will apply.

6. Claims & Liability

Written claims for damaged or pillaged cargo must be received within 14 days of receipt of goods, and the delivery docket must be noted accordingly at the time of delivery.

For non-delivery, written claims must be received within 10 days of the date the freight was due.

Where a discrepancy is caused by an airline, shipping company, handling company, cartage company, or terminal, Logistics Connection accepts no liability, but will assist wherever possible in resolving the claim with the company concerned.

Logistics Connection is not responsible for preparing claim letters and is not liable for claims rejected as a result of any failure in this regard.

Payment of invoices may not be delayed or withheld due to any claim in progress on that or any other shipment.

Liability is limited in accordance with the applicable local and international conventions and laws.

For goods stored on behalf of clients, all goods are held at the owner's risk. Clients should arrange their own insurance.

These Standard Trading Terms & Conditions apply to all services provided by Logistics Connection Limited. Where applicable, they operate alongside the mandatory provisions of the Carriage of Goods Act, international transport conventions, and other relevant legislation.
